Terms of Service

Last updated: 1 January 2025

Summary: By using Trimly, you agree to these terms. You own your business data. We provide the platform and keep it running. Subscriptions renew monthly and can be cancelled anytime.

1. Acceptance of terms

These Terms of Service (“Terms”) govern your access to and use of the Trimly platform, including our web admin dashboard, Android POS application, and any associated APIs or services (collectively, the “Service”), operated by Trimly (“Company”, “we”, “us”).

By registering an account, accessing, or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business, and “you” refers to both you and the business.

If you do not agree to these Terms, do not use the Service.

2. The Service

Trimly provides salon, spa, and wellness business management software including appointment scheduling, point-of-sale processing, client management, staff management, analytics, loyalty programs, gift card management, and related features.

Features available to you depend on your subscription plan. We reserve the right to add, modify, or remove features with reasonable notice where such changes materially affect your use.

3. Accounts and access

Account creation

You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

Staff access

You may grant staff members access to the Service through the admin dashboard. You are responsible for all actions taken by your staff under their accounts. You must revoke access promptly when staff members leave your organisation.

Account security

Notify us immediately at hello@trimlyos.com if you become aware of any unauthorised access. We are not liable for losses resulting from unauthorised use of your account credentials.

4. Subscriptions and billing

Trial period

New accounts receive a 14-day free trial with access to Pro plan features. No credit card is required to start. At the end of the trial, your account reverts to a limited state until you subscribe to a paid plan.

Paid plans

Paid subscriptions are billed monthly in UGX via Flutterwave. Prices are shown at the time of subscription and on our pricing page.

Renewal and cancellation

Subscriptions renew automatically at the end of each billing period. You may cancel at any time through the billing section of your admin dashboard. Cancellation takes effect at the end of the current billing period — you retain access until then. No partial refunds are issued for unused time.

Price changes

We will give at least 30 days' notice of any price changes by email and in-app notification. Continued use after the notice period constitutes acceptance of the new pricing.

5. Your data

You retain full ownership of all data you input into the Service — including client records, transaction data, staff information, and business configurations (“Your Data”).

By using the Service, you grant us a limited, non-exclusive licence to store, process, and transmit Your Data solely for the purpose of providing the Service to you.

We do not sell Your Data or use it for advertising or profiling. Our full data practices are described in our Privacy Policy.

6. Acceptable use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Process payments for illegal goods or services
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorised access to the Service or its infrastructure
  • Reverse engineer, decompile, or extract source code of the Service
  • Resell or sublicense access to the Service without our written permission
  • Use automated means to access the Service in ways that exceed normal business use

7. Intellectual property

The Trimly platform — including its software, design, trademarks, and proprietary content — is owned by Trimly and protected by applicable intellectual property laws. Nothing in these Terms grants you ownership of any part of the platform.

8. Service availability

We aim to provide a reliable service and target 99.5% uptime for the cloud components of the platform. The offline POS is designed to function independently of cloud availability. However, we do not warrant uninterrupted availability and are not liable for losses arising from outages.

9. Limitation of liability

To the fullest extent permitted by law, Trimly shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or business.

Our total aggregate liability for any claim shall not exceed the total fees paid by you to Trimly in the 3 months preceding the claim.

10. Termination

You may terminate your account at any time via the admin dashboard or by contacting us. We may suspend or terminate accounts that violate these Terms, fail to pay, or where required by law.

Upon termination, we retain your data for 90 days to allow export, then permanently delete it. You may request earlier deletion.

11. Disputes and governing law

These Terms are governed by the laws of the Republic of Uganda. Any disputes shall be resolved by the courts of competent jurisdiction in Kampala, Uganda.

12. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by email and in the admin dashboard at least 14 days before changes take effect. Continued use constitutes acceptance.
